and delay making cuts until congress gets together. if the pain of those cuts which is supposed to make congress act doesn't come, then perhaps congress will not act. the government will wisely try its best to reduce the amount of economic turmoil we might see in the new year, is potentially lessening the political pressure it needed to bring that turmoil to an end. maybe the market or the ceo's will be scared enough they will mobilize before the effects are felt on main street, maybe they will force congress to act before the public knows anything is really wrong. but maybe not. eventually if we go over the cliff, the government will not be able to hide the effect. the white house won't even want the agencies to hold out for very long, maybe just until the end of january. they want someone to feel the pain, so they'll make a deal, he told us. if i'm trying to get them to reach a deal, i want the feds contractors to start saying their contracts have been cut. this is a dangerous game they're playing. they hurt the economy just enough they break the other party's will, but not so much th

is the urgency? why isn't congress doing something about this and coming together? >> i know you've used the term sense of urgency, but i think people want common sense and that's common ground. there will be a sense of urgency if we fail to avoid the fiscal cliff, go over it and the markets react badly to it. right now people want us to come together in a bipartisan way. the absolute has to be bipartisan in the house. we've seen that in the last week. not even plan b, which is an unreasonable alternative to the too,000 threshold was able to garner a majority in the house of representatives. the speaker can't sell it to his own party, so i think he has to craft a bipartisan solution one way or the other, put aside the politics here. the nation's economic will suffer. >> should it come from the senate or from the house? >> i don't think it matters where it originates, but the point is the senate has already passed a bill that represents a reasonable compromise. extend the 250 -- the tax cuts for all incomes up to $250,000, and everybody would benefit on that first $250,000 of income. that it not o

and congress appears not to be able to come together unless we continue bumping along. >> for once, i completely agree with you. that terrifies me to be honest. cnbc has been a rise above campaign. the election is over and put all the partisan rhetoric aside. starbucks in d.c. locations having the employees and maybe the employee's choice, not a formal campaign, but they come together on some cups. the message is clear. we have to change it from the outside in. if d.c. is not going to change itself and d.c. is not going to get together and rise above and solve this problem, it's you and me and customers and it's even corporate america needs to put the external pressure on to say listen, guys, we need to get a deal done. you are probably a billionaire by now. you don't want to see taxes go up, nor do i. i argued in part for the president's tax hike. not because i want to pay more. who wants to pay more? we need to get to the bigger problems and put this behind us and move on to solve the bigger problems that we have got in this country and part of negotiation is not getting everything

in this country, you know, we've been divided for a while over small ideas and now we're coming together unfortunately after this tragedy over a big idea. and that's gun control. can't tell you how much the major city police chiefs of this country support the mayor. senator feinstein, congress, state senators, and mayors like mayor lee that we're fortunate to have, on gun control. senator feinstein will re-submit the assault weapons ban which bans 100 specific assault rifles, including the weapon used in sandy hook and high-capacity magazines of 10 rounds or more. there's other things that we as major city chiefs would like to see happen, such as the banning of internet ammo sales. we'd like to see in-person transactions. the record of sales and licensing of ammo vendors, and other things i can talk to you about off line. we are doing everything we can to make san francisco a safer place and reduce violent crime. the mayor spoke of ipo, which he introduced at the very beginning of august. and for the first august in memory and maybe even on record, we suffered zero homicides in that mon

or bad. hopefully in the first week to 10 days of the new year with the new congress and a fresh start that the two parties will be able to come together and hash this thing out. i think republicans have to be worried about the way the public has seen all this. i think they have enormous incentive to deal right now because the poll numbers show that obama's numbers are gaining. democratic numbers are gaining. they're up in the 50s. republicans are down in the 20s and 30s. i think republicans lost the economic debate for now with democrats. i think there is lot of pressure on them to get this deal done soon and then, you know, we will start all over again because there will be a presidential budget in february and we'll be back at the table, negotiating this with the republicans right away. so it is just, should be seen as a little fiscal break or a fiscal, we'll come up with a better analogy but temporary stopgap measure what will then be, we're going to be starting this debate all over again in february. heather: mark, in terms of, you know, who the blame is placed upon and in terms o

's right. december 31st. a lot going on there. a lot of these budget calamities coming together all at once. economists already warning the fiscal cliff situation could cause another recession. now we're about to hit the nation's debt ceiling. secretary geithner in a letter to congress did go ton say, quote, he would take extraordinary measures and say these extraordinary measures can create approximately $200 billion in head room under the debt limit. under normal circumstances the amount of head room would last approximately two months. however, given the significant uncertainty that now exists with regard to unresolved tax and spending policies for 2013, it's not possible to predict the measure. because of the uncertainty of the fiscal cliff they don't know whether they have enough head room to make sure the nation's debt ceiling doesn't reach limit within two months. the bottom line is even if we deal with the fiscal cliff in the next few days and avert that. there is another crisis with the debt ceiling looming in under two months, harris. big deal. >> harris: i know we have been talki

and the fourth amendment go hand in hand. they emerge together. to discount or to dilute the fourth amendment would be to deny really what constitutes our very republic. but somehow along the way, we became lazy and haphazard in our vigilance. we allowed congress and the courts to diminish our fourth amendment protections, particularly when we gave our papers to a third party. once you gave information to an internet provider or to a bank. once we allowed our papers to be held by a third party such as telephone companies or internet providers, the courts determined that we no longer had a legally recognized expectation of privacy. now, there have been some dissents over time. justice marshall disscented in the california bankers association versus shultz case, and he wrote these words -- "the fact that one has disclosed private papers to a bank for a limited purpose within the context of a confidential customer-bank relationship does not mean that you have waived all right to the privacy of your papers. but privacy and the fourth amendment have steadily lost ground over the past century. from

the democratic leadership -- that we must come back as soon as possible to work together to reach compromise, to ensure that we address the important legislation that is still pending in this congress, a congress which i believe has been the least productive, most confrontational, the least compromising congress in which i have served, and i have been here since 1981. the senate tomorrow will consider the sandy supplemental legislation. hopefully they will pass that tomorrow or by saturday. certainly, the house of representatives needs to address that supplemental to give relief to those that were savaged by sandy in the worst storm that has hit the northeast perhaps in history. the violence against women act passed senate overwhelmingly, something that we could work on today. the farm bill expires on december 31. milk prices will spike substantially if that bill is left to expire. mr. cantor indicated that would be addressed before we left here at the end of the 112th congress. that is some six days, a week off, four days until december 31, obviously. the foreign intelligence surveillance a
